Civil War Uniform Insignia
can you please help identify the soldiers uniform?
in the picture, he appears to be seated, has a uniform, downward shoulder stripe, belt buckle (kinda looks like an E) and a hat similiar to a beret with insignia that looks like cross sabers, (also looks like a flourish or something on top) was taken in tx and looks like civil war era to me but im not sure. please help me if your familiar with militia/history/ or just like researching

i totally believe in ghosts but i just cannot make out a soldier in those pictures sorry. i tried for like 20 minutes. sorry ill star it to see if any of my contacts might know.
